Essential Workforce Housing, LLC vs. Florida Housing Finance Corporation
The issue in this case is whether Essential Workforce Housing, LLC (“Essential”) provided Florida Housing Finance Corporation (“FHFC”) with sufficient documentation in its application including the cure process to establish site control. Specifically, the issue for determination is whether Essential demonstrated site control by providing a valid assignment of the Qualified Contract. Based upon the Findings of Fact and Conclusions of Law recited in the Recommended Order, the Hearing Officer recommended that a Final Order be entered determining that Essential had failed to meet threshold requirements relating to site control.
Bonita Cove, LLC v. Florida Housing Finance Corporation
On or before, April 27,2008, Bonita Cove, LLC ("Petitioner") submitted its 2008 Universal Cycle Application ("Application") to Florida Housing Finance Corporation ("Florida Housing") to compete for funding/allocation from the SAIL Program, an allocation of competitive housing credits and a Supplemental Loan to help finance the construction of a 60-unit high-rise development for the homeless in Miami, Florida. Petitioner timely filed its Petition, pursuant to Sections 120.569 and 120.57(2), Florida Statutes, (the "Petition") challenging Florida Housing's scoring on parts of the Application. Florida Housing reviewed the Petition pursuant to Section 120.569(2)(c), Florida Statutes, and determined that the Petition did not raise disputed issues of material fact. An informal hearing was held in this case on August 27, 2008, in Tallahassee, Florida, before Florida Housing's designated Hearing Officer, Diane Tremor. Petitioner and Respondent timely filed Proposed Recommended Orders. After consideration of the evidence, arguments, testimony presented at hearing, and the Proposed Recommended Orders, the Hearing Officer issued a Recommended Order. The Hearing Officer recommended Florida Housing enter a Final Order finding that Florida Housing's final scoring of Petitioner's application be upheld, and that Petitioner's application be rejected for failure to establish threshold requirement that water and sewer infrastructure be available to the project site as of the application deadline.

What differentiates you from other lawyers in your community?
My maturation process as an attorney. I was hired by IBM's largest business partner in North America out of law school and was subsequently recruited to work from the Executive Suite of a multi-national, publicly traded company in Luxembourg City, Luxembourg. Upon returning to the United States, I served as a General Counsel of two companies prior to opening Pomeranz Law PLLC (pomeranzlaw.com). The decade-plus of experience working as an attorney for companies has positioned the firm to support businesses of all sizes throughout the State of Florida.
What is the most rewarding aspect of your job?
Winning. This can mean different things depending on the matter, situation, client's objectives, etc.; however, helping a client navigate through a difficult situation to ultimately find a positive resolution is a great day.
