Attorney for the for Plaintiff-Appellee- in a 1999 case in which the Appellant appealed the trial court's ruling, claiming said court failed to require his former wife (Appellee) to pay past taxes owed on the basis of an IRS audit, interest owed to Mr. Franz on a community asset (the family home.) The Appeals Court found that no interest was owed however they found that the trial court erred in failing to assess Mrs. Franz (Appellee) with her share of taxes, penalty, and interest owed for the couple's 1993 and 1994 self-employment taxes and ruled the debt should be divided equally between the parties (judgement reversal.) All other parts of the judgment were affirmed and the costs of the appeal were assessed equally between Appellant and Appellee.
