IN RE SOUTHERN MONTANA ELECTRIC GENERATION AND TRANSMISSION COOPERATIVE, INC.

Counsel to the Chapter 11 trustee in nearly all facets of this complex case and two related appeals. Matters include attending to four adversary proceedings; defending the estate against stay relief and abstention motions, motion to intervene, motion for recoupment, and motion to convert; and engaging in the plan process through disclosure statements and plans.

PAULI V. SCHNEIDER (IN RE SCHNEIDER)

Counsel to defendants in adversary proceeding that challenged their discharge, prevailing after trial.

IN RE SUPRA TELECOMMUNICATION AND INFORMATION SYSTEMS, INC.

Co-counsel to largest Florida competitive local exchange carrier in its Chapter 11 reorganization, and related litigation outside of Bankruptcy Court. In process, litigated numerous contentious matters with Bellsouth, ultimately resulting in reducing Bellsouth's claim from some $170 million to about $37.5 million. Confirmed plan of reorganization.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

I represented a company in a chapter 11 case that had a serious dispute with its landlord such that the company had to file bankruptcy to stay the eviction proceeding against the landlord in order to remain in the premises and continue to operate. Once in bankruptcy, I researched and identified a defect in the eviction procedure that the landlord used. Once communicated to the landlord, and following some litigation, we were able to reach a comprehensive settlement with the landlord that paved the way for the company's consensually bankruptcy dismissal.

How did you build a successful practice?

I try my best every day to be responsive to my clients' needs, whatever they may be, and render quality legal services in a reasonable and professional manner.

What should clients look for in a lawyer?

Clients should strive to find a lawyer who can effectively help them with their legal issues. All lawyers are different, just like clients, but if I was searching for a lawyer to hire, I would want one who has a strong reputation for competency, advocacy, reasonableness, and professionalism.

How important is local knowledge to the success of your cases?

Local knowledge is extremely important as there are always practices, customs, and otherwise ways of doing things (or not doing things) that can be helpful in a matter.

I always strive to provide the best legal advice possible within the clients' budgetary and temporal constraints. And I endeavor to do so in a professional manner, respectful to the client, any opposing counsel, and the court.

What is the most rewarding aspect of your job?

When I am able to actually make a difference for a client such that the solution to the legal problem is achieved in a manner that exceeds the client's expectations.

What are your other interests in addition to law?

I have a wonderful wife and three children, as well as special extended family and friends. Any activities with them is always great, whether it is, for example, skiing, hiking, biking, or just watching a movie.

Are you involved in your community?

Yes. I am a member of Rotary Club, volunteer my time at my childrens' school, and help judge high school mock trials.
