About Kirk
Since joining the firm in 1971, Mr. Shaw's practice has spanned the fields of labor and employment law and civil litigation. He represents employers exclusively in employment litigation and labor matters. He has extensive experience litigating employment discrimination, tort and contract claims in federal and state courts. He also defends employers before the various federal agencies, including the EEOC, NLRB, OSHA, OFCCP and DOL's Wage & Hour Division.
Mr. Shaw's broad experience encompasses virtually all aspects of labor and employment law. He counsels and represents management in labor relations issues, including avoiding union organization, collective bargaining, strikes and picketing, and labor arbitrations. He advises and gives practical guidance to human resource personnel in developing and administering personnel policies and employee handbooks, making discipline and discharge decisions, preparing employment and noncompetition contracts, conducting supervisory training programs, administering employee benefits, and complying with the host of federal and state employment laws that challenge employers.
Mr. Shaw represents employers in a wide spectrum of business and industry, including computer software, banking, health care, engineering, federal contracting, maritime construction, paper manufacturing, stevedoring, trucking, wholesale distribution and retailing.
Mr. Shaw is admitted to practice before the United States Supreme Court, the Eleventh Circuit Court of Appeal, all federal courts in the state of Alabama, and state courts in Alabama and Florida. He has been recognized for his expertise in labor and employment law in The Best Lawyers in America since 1995, a "Super Lawyer" (since 2008) and a "Top Lawyer" in Alabama (Birmingham Magazine (2007). He has been a contributing author to the last several editions and supplements to How Arbitration Works.
Mr. Shaw has served on the Mobile County Judicial Nominating Commission. He currently serves on the Board of Directors of the Southern District of Alabama's Federal Defenders Organization. He has been the Chairman of the Alabama Gulf Coast Chapter of the American Red Cross, receiving its leadership award in 2006, and has served on the Board of Keep Mobile Beautiful, Inc. Prior to law school, Mr. Shaw was a Captain in the United States Army Air Defense Command.
