Pyper, Phoenix, was reprimanded. Mr. Pyper will be placed on probation for two years. He was also assessed the costs and expenses of the disciplinary proceeding. In one matter, Mr. Pyper failed to provide a writing of the scope of the representation and the basis of his fee. He revealed information not reasonably necessary to establish a claim or defense, and he sought treble damages for unpaid wages under A.R.S. §23-355 in the civil complaint that he filed against a former client. Mr. Pyper acknowledged during the default hearing that characterizing his relationship with the former client as that of an employee/employer was a twist and that nothing in the fee agreement substantiated that relationship. In a second matter, Mr. Pyper failed to act diligently in representing the client and failed to advise her that a counterclaim had been filed and would cost her more money, that the counterclaim left her open for attorneys fees from the plaintiffs/counter defendants, that the matter had been moved to Superior Court, that he failed to appear for several court hearings, and that he was withdrawing while an application for attorneys fees was pending.
