Notable Work
Plaintiff: Attorney for the plaintiffs, Earnest and Tammy Kennedy. The plaintiffs and the defendant, Marcia Langston, owned adjoining tracts of land. One lot was lake side and the other was road side. An easement was created to provide the lake residents access to the road and the roadside residents access to the lake. The plaintiffs owned the roadside lot and were leasing the pier on the lake. The defendant, some years later, purchased the lakeside lot and immediately closed the pier. The plaintiff filed suit against their neighbor and requested a declaratory judgement that included their valid lease agreement for the pier and a valid easement agreement. The courts granted the plaintiffs a temporary restraining order which prevented the defendant from interfering with their access rights or their right to use the pier per their lease agreement.
