About Mervyn

My mission is to vigorously fight for my client and to make sure my client is protected from unfair and abusive government or law enforcement actions. I am committed to helping those accused of a crime get through their ordeal, and to get the best possible result for them.

The key to building a solid defense in federal criminal cases is to have an attorney with a depth of experience as a trial attorney in the federal courts. The federal rules of procedure are specific rules of law, and an attorney well-versed in these rules will be the best-case scenario to have on your side in a federal criminal defense case. Attorney Mervyn M. Mosbacker Jr. is licensed to practice in the United States District Courts for the Southern, Western, and Eastern Districts of Texas, the Eastern District of Wisconsin, and the District of Columbia in Washington, D.C. He is also licensed to practice in the United States Courts of Appeals for the Fifth Circuit and the Seventh Circuit. More importantly, he has extensive federal trial experience in both defending and prosecuting federal cases.

Specific Experience

I recently handled a case for a federal employee accused in federal court in Tacoma, Washington of defrauding the government. I submitted legal arguments to the court that resulted in the case against my client being dismissed. I handled a case for a woman accused in Harris County, Texas of aggravated kidnapping, for which the possible penalty is 5 years to 99 years to life. By thoroughly reviewing the case and investigating, I was able to show the prosecutor that the State was likely to lose if the case went to trial. The case was dismissed against my client. I handled a possession of marihuana and unlawful carrying a gun case for a young man accused in Harris County, Texas. The marihuana and gun were found in his car when he was stopped by the police. I was able to convince the prosecutor to dismiss the case, due to a question I was able to raise about whether the marihuana was actually his. The case against him was dismissed. I handled a case for a man accused of being a felon in possession of a firearm in federal court in Houston, Texas. He had several previous felony convictions, including violent crimes. The gun was found in the house where he was living. After a jury trial, I was able to convince the jury to find him “Not Guilty”. He was released from jail. I handled a case for a man accused of two assaults on police officers in Fort Bend County, two felony charges. The officers had gone into his apartment, and they claimed that he hit them. I was able to convince the grand jury, through a written presentation which I prepared and submitted to them, that the man should not be indicted for these serious crimes. The grand jury returned a “No Bill”, and this felony case was dismissed due to my efforts. The county later charged him with a misdemeanor case of obstructing a peace officer. The case went to trial before a jury, and my client was found not guilty due to my efforts. I am a very experienced attorney who will fight vigorously to protect your rights and to make sure we get the best result possible for your case. I work closely with my clients, who can rely upon my extensive experience as a successful trial attorney (over 150 jury trials in felony cases, state and federal). My background as a prosecutor, familiar with federal and state practice, who rose to the top as a United States Attorney appointed by the President of the United States, gives me a unique perspective that I use to the advantage of my clients. I know how prosecutors and law enforcement officers think, but I no longer think as a prosecutor. I’m on my client’s side and will use my knowledge and experience to help me fight for my client.
