He is the third generation of a family that has been involved in the practice of law in Columbus, Ohio since 1919. He received his J.D. from Ohio Northern University in 1981 and also attended law school at Emmanuel College, Cambridge, England through the University of Richmond (Va.) law school in the summer of 1980. He received his B.A. in history from Yale University in 1976 and his A.M. in history from Brown University in 1977.
He became licensed to practice in all courts in the state of Ohio in 1981 and in the U.S. Courts for the Southern and Northern District of Ohio in 1982 and 1990 respectively. He became licensed to practice in the Sixth Circuit Court of Appeals in 2001 and in all the courts, including the federal courts in the states of Kentucky and West Virginia in 2004 and 2006 respectfully.
He is an active member of the St. Mark’s Episcopal Church, Tri-Village Sertoma, and the Tri-Village Chamber Partnership.
QUESTIONNAIRE
This office was hired in 2020 by a company in New York and the plaintiff had filed a complaint in Columbus, Ohio Federal Court. The contract at stake required it to be filed in New York. We filed a motion to dismiss due to venue, the case was dismissed and the plaintiff decided to refile in New York.
How did you build a successful practice?I built a successful practice for several reasons. I was with a large firm from 1984-1997 where I was hired to do consumer collection work and bankruptcy. When I left the firm I had developed a reputation in this area of work and could build a practice in that area. Furthermore, I began speaking at seminars which can result in contacts and developed a referral network.
How important is local knowledge to the success of your cases?Local knowledge is important where the attorney is familiar with and knows the judges and other attorneys in the area. It is also important to understand the procedures and rules of the local courts. It is helpful to be involved in local legal organizations where you know most of the participants.
What information can you provide in a free phone consultation?The information that I could provide in a free phone consultation is my background and experience and the costs of the customers case. We provide numerous ways of billing. It is not all hourly but there are flat rates and contingencies and could explain that in a free phone consultation.
What information do you need in a free phone consultation?The information that I need are the specific details of the case to determine whether there is a case and how viable it may be. I would need all the information relating to the case.
What differentiates you from other lawyers in your community?What differentiates me from other lawyers in my community is experience and longevity. I have been practicing almost forty years and is the third generation of a family legal practice that began in 1919. I have been in small firms and large firms and completely understand the advantages and disadvantages of each. I have lived in Columbus Ohio my entire life.
What is the most rewarding aspect of your job?The most rewarding aspect of my job is an ongoing thing. I am most interested in my clients welfare and helping them any way I can. We seek to prevail in all cases and win the client’s gratitude.
What are your other interests in addition to law?Other interests include American history and American and English literature, animal welfare, environment, NHL hockey, Big Ten and Pro football. I have four grandchildren and have followed their athletic programs as well as other programs. The ages range from 3-21. Two of them were inducted into the National Honor Society.
Are you involved in your community?I have been involved in the community for many years. In my younger years I was an officer of the Columbus Jaycees. I am a member of Tri-Village Sertoma which is a service organization and was president in 2017. I am a member of St Marks Episcopal Church my entire life. I have ushered and done challis bearing there. I have sponsored teams in amateur basketball programs relating to my grandchildren.

Cases
First Bank of Ohio v. Cole
Decision: Trial court case no. CV-18-90339, appellate court case no. CA-19-108215(2019)-the trial court found in favor of the creditor on a default judgment. However, the trial court gave us the statutory interest rate of 5%, rather than 25% as required by law. Creditor appealed and filed its appellate brief. A few days before oral argument the Court ordered the lower court to correct the interest rate to 25%.First Bank of Ohio v. Tufts
Decision: Case no. 19923010, Cuyahoga County Common Pleas Court (2019-2020), creditor obtained a default judgment, but it was problematic. Judgment was rendered only for the principal balance at the statutory interest rate. Creditor filed for reconsideration of the judgment which was granted.Bank One, Dayton N.A., v. Doughman
Decision: 59 Ohio App.3d60 (Hamilton County, 1988) - this case re-established the doctrine that Banks and their customers are not subject to RISA.
