It wasn't my plan to practice law defending the rights of homeowners. However, I feel that I am uniquely qualified as I went through that process myself when I decided to leave the Air Force, as a fighter pilot, to go to law school. I realized that I could not make my mortgage payment, so I negotiated with my lender and gave it a deed in lieu of foreclosure. Our family went through a very difficult time when we gave up our home and moved on campus at the University of Miami, during this time my wife was working making $14K per year and supporting the family. I was subsequently elected State Senator to the Florida Legislature in 1990, where I served until 2002. During that time I amended the foreclosure laws approximately 11 or 12 times. I never thought that I would be involved in defending homeowners with this plight in the future. I got involved with the process when a couple of friends where going through a difficult time and about to lose their homes because of the economic down turn. I referred them to someone else and they were not happy with how their case was being handled. They persuaded me to help them. Since I knew the law well, having worked on it in the Florida Senate, I got them a loan modification in about 3 months. They were very relieved and satisfied. These two friends referred 35 new clients to me. This is when I decided to open my own firm. At that time I had retired from law for 3 years. When dealing with the courts, most lawyers and borrowers accept that most of the time a judge will find in the bank's favor once you acknowledge 1) that you borrowed money to buy or refinance a property, and 2) that you stopped making the payments. Nearly 99% of the time the banks win and the borrowers lose. I wanted to find another solution to satisfy the bank and help borrowers, and I have done so. We can win in court, and I am uniquely qualified because I have been through it myself. I have also been on the board of a bank for the last 9 years, chairing its audit committee. I understand how banks view this process. I also have access to much of the policy making of other banks and an understanding of what their thinking is in these situations. Having been an investment banker for 9 years and understanding the securitization aspects of what happens with mortgage loans, I come to the table with a different perspective than attorneys that are only familiar with one side of the equation. The solutions for our clients are custom designed for each individual case. The options range from foreclosure defense and loan modifications, to deeds-in-lieu of foreclosure and short sales. Every solution we offer is based on what our client wants to achieve. Having been a fighter pilot, my team and I do not know the meaning of giving up. Please describe a case in the last year or two where you made a big difference.

One client in foreclosure was on disability social security and no other income making $1242/month. She had a $194K balance due on her loan with a $1049/month mortgage payment. We successfully defended the foreclosure and in October 2017 negotiated a loan modification which gave her a 40 year term at 2% interest for the life of the loan. The lender deferred $52K of the balance to a non-interest bearing account. The new monthly mortgage payment (including taxes and insurance) is $480.76 which she can easily make.

How did you build a successful practice?

Through referrals. As a former state senator, I amended foreclosure law about 14 times to benefit borrowers never thinking I would practice in this area. When two friends who were in foreclosure asked for my help in 2008, I found I knew everything about this area of the law. I defended their foreclosure lawsuits, helped them obtain much lower mortgage payments, and dismissed the lawsuit against them. These two friends referred 38 other clients, who then referred over 400 new clients. Our practice has grown since.

Clients should look for 3 key characteristics in a foreclosure defense lawyer. a. Does the lawyer know anything about lenders? In any adversarial situation, the better you know your opponent the better you can prepare and obtain a favorable outcome. A lawyer who knows banks, their regulations, and processes has a decided advantage in these cases. b. Can the attorney help you reach your goal? Ask the attorney whether s/he has significant experience helping others accomplish one of these goals.
