Ms. Morton has successfully represented working people in litigation in federal and state courts, before federal and state administrative agencies and in mediation and arbitration. Ms. Morton (with Ms. Faris) is currently representing FedEx Ground drivers in more than 30 states in a federal multi-district action challenging the company’s misclassification of its drivers as “independent contractors.” See In re FedEx Ground Employment Practices Litigation, N.D. Ind., No. 05-MD-527. Ms. Morton served as co-counsel (with Mr. Monrad and other Leonard Carder attorneys) in successful class action lawsuits against Best Buy Stores, Inc. and Extended Stay America, Inc., challenging the misclassification of managers and denial of overtime compensation. See Roberts v. Best Buy, Contra Costa Co. No. C02-01642; Reid v. Extended Stay America, Inc., Alameda Co. No. 2002 055285. Other successful cases litigated by Ms. Morton on behalf of workers include International Organization of Masters, Mates and Pilots v. Mainella, No. 06-cv-2107, 2006 WL 1466829 (N.D. Cal. May 26, 2006) (enjoining the National Park Service from failing require the payment of prevailing wages to the employees of the successor federal contractor) and International Organization of Masters, Mates and Pilots v. Rea, Alameda Co. No. RG0625337 (obtaining a ruling expanding workers’ rights under state prevailing wage laws and resulting in a $5.2 million settlement for unpaid wages).
