- In 2005 Governor Arnold Schwarzenegger signed into law a comprehensive new workers compensation law. George Henderson made a point of educating himself in the new law, so that he is able to use the new law to maximize the settlement value of each workers compensation claim. For example, whereas the former law only emphasized injuries to the musculoskeletal system of the body, the new law mandates treatment of the whole person.
GEORGE HENDERSON uses the new law concept of "treating the whole person" to build the settlement value of the case. Thus if the person injured at work has internal medicine complaints such as elevated blood pressure, or elevated blood sugar due to inactivity and stress following a job injury, these injuries can be added to the traditional orthopedic injuries to greatly increase the value of the case. - GEORGE HENDERSON also recognizes the fact that a worker injured on the job who has been given disability leave from work, will typically suffer depression and anxiety. The mere fact of having to live with pain, and sleep loss contributes to feelings of depression and anxiety. Worry about an uncertain future almost always results in anxiety. GEORGE HENDERSON always includes claims for psychiatric injury where his clients injured at work have such complaints. This provides much needed therapy and also increases the settlement value of the claim.
- The above reference to injury related depression and anxiety is to be distinguished from the work injury claim classified as "job stress." Job stress occurs when work conditions, or a hostile work environment result in psychiatric injury while the injured employee is still at work.
