Matthew Moroney co-chairs the firm’s Insurance and Healthcare Fraud Litigation department.

Matt regularly counsels insurance carriers on multi-claim investigations involving healthcare providers located in New York, New Jersey, Pennsylvania, Delaware, and Maryland.  Matt and his team regularly analyze complex data, including medical records and billing, on an individual and multi-claim basis to identify questionable patterns and to assess potential fraud.  Matt has successfully litigated large scale affirmative actions with fraud, RICO, and declaratory judgment claims, which recouped millions of dollars for his clients.

Matt also leads the firm’s Recovery and Subrogation Team.  Through the firm’s aggressive and proactive strategies, GMR provides cost-effective representation to its clients who have made substantial recoveries.  Because casualty losses can strike at any moment, Matt and his team are available around the clock to provide timely and proactive investigations using the newest technologies.

For more than 18 years, Matt has accumulated extensive trial experience in the state and federal courts in New York, New Jersey, and Pennsylvania.  He is well-versed in state and federal civil procedure and evidentiary practice. Matt has extensive experience in all stages of litigation from the initial pleadings through appeals, and extensive expertise conducting examinations under oath of insureds and healthcare providers.  

During his career, Matt has won well over 75 jury trials, and many more nonjury trials and arbitrations, Matt is equally as proud of the meaningful results he achieved for clients without stepping foot into the courtroom.  Matt and his team are committed to helping their clients limit their exposure on questionable claims and ensure that they are not damaged by fraudulent practices in the future.

$450,000 PERSONAL INJURY SETTLEMENT FOR CLIENT INJURED BY SPORTS ENTERTAINMENT COMPLEX SECURITY STAFF

While GMR typically focuses on defending personal injury matters, we also routinely represent individuals who were injured by the negligence or recklessness of others. In these circumstances, GMR utilizes our extensive litigation experience on both sides of a case to achieve the best possible outcomes for our clients. The above settlement came out of a Philadelphia County case litigated by partner Matt Moroney. In this matter, GMR’s client was attending a public event when a security employee inappropriately grabbed his arm, which caused a spiral fracture of the mid-distal humeral shaft. Without any wage loss or outstanding medical bills, we were able to obtain discovery that resulted in a $450,000 settlement. We utilized our experience as both a defense firm as well as counsel for plaintiffs to gain important evidence through depositions and the use of experts to achieve a substantial settlement for our client. As always, GMR was ready to try the case to verdict. Even though the defendants denied liability, the defendants substantially increased the settlement offer on the eve of trial, and we were able to resolve the matter with a favorable settlement for our client.

MATTHEW MORONEY WINS A SUFFOLK COUNTY SUPREME COURT JURY TRIAL

Matthew Moroney won a Suffolk County Supreme Court jury trial centering around a 2015 motor vehicle accident in which liability was still in dispute. Plaintiff alleged injury to the cervical spine, thoracic spine, lumbar spine, left knee and right hand as a result of the accident and further alleged that she continued to be partially permanently disabled. At trial, Plaintiff testified that after properly yielding and subsequently entering a traffic circle, the Defendant, who was traveling in the left lane of the traffic circle made contact with her vehicle on the driver’s side. However, during cross examination, Plaintiff’s failed recollection of where the impact points were on her vehicle, even after being shown photographs that were in evidence, greatly diminished her credibility. The Defendant took the stand and testified that he remained in his lane of traffic the entire time he was travelling in the traffic circle, and was struck by Plaintiff’s vehicle. As this was a bifurcated trial, before even getting to the damages portion of the matter, the jury, after approximately 20 minutes of deliberation regarding liability, rendered a defense verdict; the jury did not find Plaintiff as credible and accepted the Defendant’s account of the accident.

DEFENSE VERDICT IN FALL DOWN CASE

Matthew Moroney secured a defense verdict at trial in a lawsuit brought by a tenant against her landlord. The tenant alleges she fell down her basement steps which she claimed the landlord negligently maintained. After the fall, the plaintiff / tenant was taken to the emergency room and then underwent several months of physical therapy. At trial, the plaintiff sought damages for her personal injuries, along with $9,000 in unpaid medical bills. The jury, however, determined that the defendant/landlord was not negligent, and therefore, a defense verdict was entered. Matthew Moroney effectively brought out several credibility issues in the plaintiff/ tenant’s testimony, especially as to her claims regarding placing the landlord on notice of the claimed defect.
