About Robert

Being a trial attorney is founder Bob Stolzberg's second profession. Before going to Harvard Law School, he was a reporter for the Washington Post. He notes the similarities: "In both, there are two essential tasks: first, finding the facts and, second, presenting those facts in an understandable and persuasive manner." He says he prefers the law because it allows him to work closely with his clients, and gives him the personal satisfaction of helping them accomplish their objectives.


After law school, he worked on class actions and other sophisticated litigation in New York City for several years before returning to Boston in 1974, where he continued to concentrate in trial practice, representing individuals and businesses in a wide variety of litigation matters, including breach of contract, intellectual property, real estate, administrative, professional malpractice, personal injury, and criminal defense. Included in his practice is the representation of foreign nationals before American courts. Between 1975 and 1980, he was also a Special Assistant Attorney General. He has been admitted to practice before the United States Supreme Court, the U.S. Tax Court, and state and federal trial and appellate courts in Massachusetts, New York, California and Michigan. He has been appointed to the panel of Special Masters of the Massachusetts Superior Court and has been an expert witness in legal malpractice cases.

Bob has held an “AV” rating from Martindale-Hubbell for over twenty-five years.  This is the highest rating in both rating categories, for general ethical standards and for legal ability. Martindale-Hubbell is the pre-eminent national company rating lawyers. He also holds a “superb” rating from AVVO, its highest rating.  Bob was one of the first lawyers in Massachusetts to be certified by the National Board of Trial Advocacy, which is a private national organization whose standards are not regulated by the Commonwealth of Massachusetts.

Bob has been a member of the Association of Trial Lawyers of America; the Boston Bar Association, where he was chair of the Aviation Litigation Committee; and the Massachusetts Bar Association. He taught in the trial practice course at Harvard Law School on many occasions and has published multiple articles in local and national legal journals.

In addition to obtaining his Juris Doctorate at Harvard Law School, with a concentration on litigation and international law, Bob graduated with an honors degree in political science from Union College, Schenectady, NY, where his thesis explored the ramifications of diplomatic recognition of the People’s Republic of China.

Cases

Ownership of business

Outcome: Verdict for my client Description: Represented owner of prominent restaurant in dispute with another owner as to respective ownership shares. Won judgment after trial vindicating my client's claim. Subsequently successfully negotiated, with mediator, buy-out of the other owner's share.

Construction - homeowner

Outcome: Settled with client paying nothing Description: Represented homeowner in Newport, R.I. against contractor suing for unpaid bills. Obtained dismissal of case with homeowner paying nothing.

Construction - contractor

Outcome: Settled for majority of bill Description: Represented contractor where his customer alleged improper cost overruns and defects in workmanship. Obtained settlement whereby contractor got majority of disputed sums.

Unsuitable investments

Outcome: Settled Description: Obtained settlement for client in arbitration against major securities firm for making investments which were both unsuitable and did not comport with client's oral instructions to invest conservatively.

Bicycle accident

Outcome: Settled Description: Obtained $99,000. settlement for bicycle rider struck by car.

Land purchase - trial and appellate courts

Outcome: Judgment for my client Description: Represented landowner who had entered into a purchase and sale agreement for the sale of commercial property. When the deal fell through, the buyer brought suit alleging that my client had breached his agreement to sell, and seeking damages for his expenses and lost profits. I obtained summary judgment for my client dismissing all of the plaintiff's claims which was upheld on appeal.

Federal criminal defense

Outcome: Client found not guilty of RICO conspiracy Description: RICO conspiracy case. Multiple defendants. Successfully defended my client on the conspiracy count. On appeal, his conviction on another count was overturned.

Non-compete covenant

Outcome: Case dismissed Description: Represented company that hired new vice president and was then sued by his previous employer for allegedly violating covenant not to compete and for disclosing their trade secrets. Successfully defended against their request for preliminary injunctive relief, and then obtained settlement dismissing case with my client paying nothing.

Obstetrical Malpractice

Outcome: $2,500,000. verdict Description: Doctor mismanaged delivery of baby, resulting in an Erb's Palsy

Doe v. Doe (Divorce)

Description: Represented husband in divorce case. They had been married for about 18 years at the time of trial. The court awarded the Husband about 70 per cent of the couple's total assets.
