Jayson is experienced in divorce and family law, most notably in divorces, visitation, child custody and child support. Jayson offers low-fee uncontested divorces. An uncontested divorce is when both parties, or spouses, agree to sign the divorce papers. However, if there are children, property or other assets involved, then the divorce may be contested. In family court, Mr. Lutzky fights for what is best in each client’s situation and, when there are children involved, he fights for what is best for the children. He has substantial experience negotiating child support, domestic violence, child custody, visitation, alimony and division of marital asset deals. In bankruptcy law, Jayson handles Chapter 7 and Chapter 13 cases to help individuals get a “fresh start.” Many of his bankruptcy clients have credit card debt, medical bills, past due utility bills, mortgage debt and auto loans. A Chapter 7 bankruptcy wipes out debts. It puts people on a clean slate that allows them to build credit. A Chapter 13 bankruptcy is essentially a payment plan. Depending on certain factors a means test helps determine what you will pay back and who you will pay back to. The repayment time is between three and five years. Please describe a case in the last year or two where you made a big difference.

The father of my client's child had not paid child support for some time and was still not paying child support. Eventually, the judge granted my motion that, due to his willful default on child support obligations, he would be incarcerated. Shortly afterwards, he paid the money that was owed and was released from jail. Recently, both he and the mother came to my office for a separate matter. Since the first case, the father had made amends with my client and their child. He pays regular child support and now, he even has a close relation to the child. Clearly, my client and the father's experiences in and out of the court room made him a better father. I am proud to have made a difference in my client's life, her child's life and the child's father's life.

How did you build a successful practice?

Word of mouth is a major factor in how I built a successful practice. Over the years, I have found that each client refers an average of three more clients. I feel that these recommendations are clear-cut evidence of my hard work, patience, respect, and responsiveness.

What should clients look for in a lawyer?

It is important that a lawyer is compassionate and knowledgeable. Lawyers must always act in a client's best interest. That means a lawyer also needs be realistic and be able to communicate reality to a client. Clients should seek out experienced lawyers who have a successful track record in court.

How important is local knowledge to the success of your cases?

Having worked in the Bronx for many years, I am familiar with judges in Bronx Family Court and Bronx Supreme Court. I am also aware of the neighborhoods needs. Over the years, I have learned about the many situations that my clients face and I am able to take this knowledge and apply it to new cases. What information can you provide in a free consultation? At a consultation, I provide a practical analysis of your case, recommended strategies indicating work to be done and the cost. I advise the clients whether or not their case will necessitate a court appearance.

What differentiates you from other lawyers in your community?

With over 32 years of experience practicing law, I am able to provide my clients with solid and knowledgeable representation. In court, it is easy to tell which lawyers are experienced and which are not. Often, an experience gap makes a difference in the outcome of a case. Additionally, familiarity with the court system, the laws, and the process of law is an asset I am proud to offer my clients. My office staff and I are bilingual in both English and Spanish. Understanding and speaking Spanish has allowed me to genuinely serve those who speak Spanish.

What is the most rewarding aspect of your job?

Some clients, both mothers and fathers, feel that they have long odds in reuniting their family, that they will loose custody of their beloved child or that they will not be paid the appropriate amount of child support. I work hard to prepare for a court date and most times, I get the results that my clients need and deserve. It is rewarding to know that I have helped my client keep custody of his or her child.

What are your other interests in addition to law?

Vegetable gardening, Soduko, Ken Ken, Crossword puzzles, Watching the Yankees and other sports teams, Playing basketball

Are you involved in your community?

I am a small claims arbitrator. I volunteer time in the evening to hear small claims cases at the Bronx Supreme courthouse and to make decisions for the parties involved. I have also served on the board of Greenburgh Hebrew Center as well as serving as a past president.
