Schaffer, P.O. Box 30335, Tucson, AZ, was suspended for four years effective the date of the judgment and order. Ms. Schaffer was also ordered to pay restitution and the costs and expenses of the disciplinary proceedings. Upon reinstatement, Ms. Schaffer will be placed on probation for a period of two years. In the first matter, Ms. Schaffer was summarily suspended from the practice of law for non-payment of dues on June 17, 2008. Ms. Schaffer continued to accept case appointments pursuant to a contract with Pima County and continued to file pleadings and appear before the court. She did not notify her clients that she was suspended. Ms. Schaffer later withdrew from her cases, but did not tell the presiding judge she had been suspended for non-payment of dues or the length of her suspension. Ms. Schaffer failed to respond to requests for information from the State Bar or cooperate in its investigation. In the second matter, Ms. Schaffer was appointed to represent a child in a dependency matter who was placed in foster care. Ms. Schaffer was later appointed to represent the childs brother who was added to the dependency action. She did not visit the child until the child was leaving foster care. Ms. Schaffer took a position adverse to the child, advocating that the brother was better off with the child out of the home. Ms. Schaffer did not withdraw from representing either the child or the brother and continued to represent them both while suspended from the practice of law. Ms. Schaffer did not respond to requests for information from the State Bar or cooperate in its investigation. In the third matter, Ms. Schaffer filed a complaint as the attorney for her daughter, the plaintiff in a civil action, while suspended from the practice of law. Ms. Schaffer negotiated a settlement and negotiated procedural issues with opposing counsel while suspended and without informing her client, opposing counsel, the defendants insurance company or the court that she was suspended. Ms. Schaffer failed to respond to the State Bars requests for information or cooperate in the investigation of the matter. Eight aggravating factors were found: prior disciplinary offenses, dishonest or selfish motive, pat"ern of misconduct, multiple offenses, bad-faith obstruction of the disciplinary process, vulnerability of victim, substantial experience in the practice of law, and indifference to making restitution.
