Broadside Collision Results in $35K Verdict

The plaintiff was a passenger in a police vehicle, while on duty with the New York City Police Department, which was struck on the passenger side at an intersection by a vehicle driven by the defendant driver and owned by the defendant owner.

As a result of the broadside collision, the plaintiff, a 42-year-old male police officer, reportedly suffered C5-C6 central and left foraminal disc herniation with left C6 nerve root impingement, central disc herniation at C7-T1, left low cervical radiculopathy, bilateral ulnar neuropathy at the elbow, C5-C6 herniated disc with left C6 radiculopathy resulting in numbness and paresthesia of the left thumb, and post-traumatic migraines, which rendered him unable to return to work as an active duty police officer.

The plaintiff contended the defendants were negligent for failing to keep and maintain a safe and sufficient lookout and watch for other vehicles on the road; failing to keep and maintain the vehicle under safe, proper, reasonable and lawful control; failing to sound a horn; failing to stop, signal or slow down; failing to yield; failing to obey traffic control devices; failing to drive at a speed reasonable for conditions; permitting a vehicle to be operated by a known unsafe, incompetent and inexperienced driver; and were otherwise careless, reckless and negligent in the ownership, operation, maintenance and control of their vehicle; and violated statutes, ordinances, codes, rules, orders and/or requirements of state, city and/or local governments. The defendants denied liability.

The personal injury suit for the broadside collision proceeded to trial and the jury found for the plaintiff. The jury awarded the plaintiff damages in the amount of $35,000.[1]
