Criminal Felony

Summary: Were you caught bringing drugs from one point to another? Was it for personal use, or was this executed deliberately to sell or redistribute it to others? The answer could mean the difference between higher sentencing ordered by the court, or lower fines.

Drug possession alone can end in a drug diversion program, verses spending time in prison. On the other hand, if someone is caught trafficking drugs for sale, the penalties are more.

Though this offense is tough to defend, there are ways to fight and win – with the help of a lawyer.

Examples of Defenses for Selling or Transportation of a Controlled Substance

·         Entrapment –basically this transpires when the accused was coerced into selling drugs under a sting operation – even though they had no prior intention to do so. If a drug defense attorney can prove this, this can be argued in court, and will likely result in lesser or dismissed fines.

·         Improper Search and Seizure – defendants have numerous rights, even if they’re under suspicion. One is to be given a valid search warrant. In addition, if the warrant was received from police not following proper procedures, the case will perhaps be thrown out in court.

·         Personal Use – If the drugs were held for personal use alone, as discussed earlier, a lawyer can most likely file for a drug diversion program instead of jail time.

Each case is different for California Health and Safety Code 11352. A skilled drug defense attorney is able to be versatile enough to handle all types of drug cases, and win.  If  you’ve been arrested for a drug related crime, don’t delay.  Call (949) 250-6097 to speak to a lawyer, should you be on trial for Possession for Sale or California Health and Safety Code 11352.
