Expungements are beneficial for
numerous reasons. If you’ve been previously arrested, you may be subject to
discrimination when searching for a job. An arrest may withhold you from
enrolling or participating in certain organizations. So, an expungement, which
is essentially being successfully granted a clean slate from past arrests,
supplies the benefit of being alleviated from such biases, due to criminal
records.
If you’re searching for an
expungement, it would be wise to hire a lawyer, as they know the most
successful and fastest way to file with the court. They understand the ins and
outs of California Penal Code Section 1203.4.
CPC 1203.4 essentially means that
whenever someone’s record is expunged, this individual will be no longer liable
to the fines of the arrest. For anyone to be granted a California Penal Code
1203.4, they have to first complete their probation in its entirety. In
addition, they cannot commit or be charged with another crime, whether it’s a
felony or misdemeanor during their probation.
There are also exceptions to this rule.
If it is that the individual in question did time in the California State
Prison, this individual will be considered ineligible for an expungement. Child
sex offenders too, will not be granted an expungement of their duty to register
as lifelong sex offenders.
On another note, even
though the requirements for an expungement include completing a probation, if
an individual violates their probation, all hope isn’t lost. A legal team can
work hard to prove conditions like the defendants background, the severity of
the crime committed, if all fines were paid and other related factors that will
help with a judge’s discretion in granting an expungement.
An expungement with all its
advantages will not give someone a suspended or revoked license back. In
relation to this, if you once held legal rights to a firearm, and it was
revoked due to an arrest, an expungement will not recover your previous right.
