Summary: Involuntary Manslaughter under California Penal Code 192, is a criminal offense and it is normally filed as a misdemeanor. It is when someone kills someone unintentionally, as opposed to murder under Penal Code 187.

Involuntary Manslaughter under California Penal Code 192, is a criminal offense and it is normally filed as a misdemeanor. It is when someone kills someone unintentionally, as opposed to murder under Penal Code 187.

This is not to be confused however as an innocent killing, as it usually transpires during the course of an illegal action. As an example, if some drives while being drunk, that act in and of itself is illegal. If you accidentally kill someone with a car by means of running them over, or you were involved in a casualty and someone died, this is considered to be involuntary manslaughter under penal code section 192.

For the state to take an involuntary manslaughter case to trial, there are certain elements of the crime which will have to get proven, and these include that the defendant was actively involved in an illegal act, they did not make a deliberate attempt to kill anyone, but in the end someone suffered because of their irresponsibility. In other words, the killing was not premeditated and there is no malice aforethought that was carried out.

The violation of involuntary manslaughter is a misdemeanor and fines include up to one year jail time, or either 2,3/4 years in prison. In addition, the person who is guilty will have to complete a formal probation and pay fines of up to ten thousand dollars. The judge may also order a revocation of firearm rights.
