Criminal Criminal  Felony Criminal  Misdemeanor

Summary: Corporal injury can result in misdemeanor or felony criminal charges in the state of California.

CPC 273.5If someone takes a hit at being found guilty of corporal injury, this arrest can stay on their records for a very long time and also solicit discrimination when it comes to job hunting or joining an organization. That’s why if you are innocent and were falsely accused, you should take strong measures to hire a legal team.

Corporal injury is quite common during domestic disputes, and will involve cases where the victim suffers physical injury, whether this is through a cut, scratch, bruise and so forth.

In cases of corporal injury, the victim will be a spouse, ex-spouse, someone you live with or the mother or father of your child. The prosecution will have to prove that the defendant deliberately inflicted bodily injury on the victim.

At times, both parties will be tried, since it is often played out as a domestic dispute case. Other times, it is very severe and it can be filed under a misdemeanor or felony. Persons facing misdemeanor charges will be subjected to no more than a year in the county jail. They may also have to pay a fine of six thousand dollars. If filed as a felony, it subjects guilty parties to between two and four years in the state prison. Plus, felonies also warrant an official probation for CPC 273.5.

If it’s a case where the guilty party has done this criminal offense before, fines will be increased. In addition, should the judge find that you’re connected to other forms of domestic violence offenses, you could face higher penalties. You may also be required to pay monies to a women’s sanctuary or participate in community service.
