Indecent Exposure California Penal Code Section 314, is a criminal offense and it is normally filed as a misdemeanor. Indecent Exposure is the willful act of exposing oneself for sexual gratification in public.

Elements of the Crime

In order to take an Indecent Exposure CPC 314 case to trial, certain elements of the crime will have to be proven. These include:

  • That the defendant willfully exposed their privates or nude self
  • The defendant exposed them self in a public place
  • The defendant knew that this act would be offensive
  • The defendant exposed them self for sexual arousal of them self or those around them

Punishments for CPC 314

These penalties are to be determined by a judge and he/she will make a decision based on the circumstances surrounding the case, and also an individual’s criminal history.

When found guilty of Indecent exposure, it is a  misdemeanor punishable by 6 months in jail and a one thousand dollar fine. Those found guilty may also have to register as a sex offender.

In special instances where Indecent Exposure was carried out in a residential home, it is filed as an aggravated indecent exposure and when found guilty it is a felony punishable by sixteen months, two or three years in prison and a ten thousand dollar fine.
