Can You Be Denied Special Education Because Your Grades Are Good?

The Individuals with Disabilities Education Act § 300.101 states that every child aged 3 to 21 years old, including those with disabilities who have faced school suspensions or expulsions, must have access to a Free Appropriate Public Education (FAPE). Moreover, every state must guarantee that a FAPE is accessible to every child with a disability requiring special education and related services, regardless of whether the child has not experienced poor or failing grades and continues to progress from one grade to the next. Good grades alone should not cause a child to be denied special education and related services, as grades may not be the most accurate indication of a child’s learning and progress in school.
