Dallas Chapter 7 Bankruptcy Attorneys

Chapter 7 bankruptcy is also known as liquidation, but it does not mean you have to give up everything you own. Most of our clients are able to keep their assets — their home, vehicles, retirement money, personal property — under the Illinois bankruptcy exemptions.

Chapter 7 Bankruptcy · Dallas Debt Relief Lawyers

If you qualify for a Chapter 7 "straight bankruptcy," you can walk away from unsecured debts such as credit card balances, medical bills, cash advances and payday loans. It may also be possible to discharge back taxes and civil judgments. However, some debts and court-ordered obligations generally are not discharged such as student loans, child support/alimony, criminal fines or recent taxes. Our attorneys can advise on which debts you can discharge.

Most of our Chapter 7 clients do not forfeit any assets because they are covered by the bankruptcy exemptions. You will have to decide what to do with your secured debts. If you are current and continue making the payments, you can retain your house or your car. If you surrender the home or vehicle, you can generally discharge any arrears in your Chapter 7 bankruptcy.

Eligibility for Chapter 7 is determined by a means test. You might be pushed in Chapter 13 bankruptcy if you earn more than the Illinois median income. You also might have to pursue a Chapter 13 relief if you have mortgage arrears or significant assets or equity that is not exempt. Our attorneys can determine if you qualify and explain the Chapter 7 discharge process.

The knowledge and skill of your attorney make a difference, especially if you have complicating factors or strategic decisions. We can answer all your bankruptcy questions such as whether to file jointly, whether to file before or after divorce or whether co-signers are liable for your debts.
