Summary: Cinco De Mayo, Kentucky Derby, Beer, Bourbon and BBQ Festival – Be Careful Knoxville, Law Enforcement Will Be Watching for DUI and Public Intoxication

May 5th, Cinco De Mayo, is an eventful day in Knoxville this year. There are numerous activities occurring around town.

Most popular is the celebration of the Mexican army’s defeat of French forces on May 5thor better known as Cinco De Mayo. People will pack restaurants and bars ordering margaritas, chips, salsa, and Jason’s personal favorite queso.

Also, this weekend is the Kentucky Derby. Mint julep anyone?

And lastly, Knoxville is hosting the Beer, Bourbon, and BBQ Festival this weekend.

With all of these events occurring, Knoxville residents and visitors need to be vigilant, police presence will be increased. As a result, arrests for DUI, Underage DWI, Simple Possession, and Public Intoxication will go up. Jason’s best advice is, if you are going to go out and drink take an Uber. A $20 Uber ride is considerably cheaper than bailing out of jail and then hiring an attorney.

However, here is a short guide on what to do if you come into contact with law enforcement this weekend after you have been drinking:

  1. Provide the officer with your license, registration, and proof of insurance if requested.
  2. If the officer asks you any questions, politely inform him that “you will not answer any questions without a lawyer present.”
  3. If the officer requests that you perform any tests or task, politely inform him that “you will not perform any test or task without a lawyer present.”
  4. If the officer hands you a citation, sign the citation without argument and ask if you are free to leave. If you are free to leave, leave immediately.

Unfortunately, the officer will likely not be happy with your request for a lawyer, but you are well within your rights to request a lawyer. Be polite, do not be argumentative, and remember if the officer places you under arrest, not to argue or fight with the officer.

Remember an officer can use anything you say or do against you in court.
