Connecticut Court Denies Motion to Relocate for Work in Film Industry

A parent’s request to relocate with his minor child so that he could pursue his dream job in the film industry was not in the best interest of the minor child. The parties were the unmarried parents of a child who was born in May 2006. Previously, a court granted primary residence and decision making to the father and visitation with the mother on alternate Thursdays and weekends. Plaintiff mother married a police officer and worked as a case manager with Focus on recovery United. Father, who worked at Brooks Brothers, requested permission from the court to relocate with the minor child to Southern California, to pursue his dream job in the film industry.

The court found that relocation to southern California, which had a high cost of living, was not in the best interests of the minor child. “The expressed salary of 65,000.00 within the context of a significantly high cost of living in southern California,” wrote the court, “would not allow the defendant to maintain appropriate housing, transportation or day and/or after-school care for the minor child.” The court denied the motion to relocate. The court modified custody and ordered joint custody, that the parties continue to arrange counseling for the minor child, and that the plaintiff mother provide health insurance via her husband’s insurance plan.
