Divorce / Dissolution of Marriage
A divorce typically involves four areas of concern:
- Children: The best interests of the children mostly governs a family case. The court must determine a time sharing arrangement, commonly known as the Parenting Plan. Based on that arrangement, the parents’ incomes, and other factors, the court determines the appropriate amount of child support.
- Equitable Distribution: A marriage is considered an equitable partnership. During the course of the marriage, the parties accrue assets and incur liabilities. These assets and liabilities must be identified, valued, classified, and then equitably divided.
- Alimony: Where one spouse has the ability to provide support and the other is in need of that support, alimony may be awarded. Types of alimony include temporary, bridge-the-gap, rehabilitative, durational, lump sum, and permanent. The specific facts of your case will dictate the type of alimony, if any, you might expect to pay or receive.
- Attorney’s Fees: The ability to hire counsel can drastically alter a spouse’s chances to receive a fair result. The law permits one who does not have access to funds to secure legal representation paid for by the spouse.
