ADHD is recognized as an “Other Health Impaired” disability covered by the Individuals with
Disabilities Education Act (IDEA). The IDEA is very specific and provides a narrow definition of
what qualifies as a disability, which leads to many children being denied services. If a child's
ADHD is coupled with another disability, or if it causes a severe enough impairment that
requires specialized instruction, they may qualify for special education and related services
under the IDEA. When a child is deemed eligible under the IDEA, an Individualized Education
Plan (IEP) is developed to address their special education needs.
Section 504 of the Rehabilitation Act states that the needs of students with disabilities must be
met to the same extent as students without disabilities. Due to the specificity of the IDEA, it is
common for students with ADHD who are not eligible for an IEP to be granted a 504 plan. Under
Section 504, a disability is an impairment that severely limits at least one major life activity,
including learning. If a child’s ADHD seriously interferes with their ability to learn, they may
qualify for a 504 plan.
