Summary: Getting your license back after a DUI in Florida

The rules have changed when it comes to getting your license back on a DUI case. The earlier method on a first offense DUI charge for a regular (not Commercial) license was to request a formal review hearing within 10 days of the person arrest. That method still exists but if the hearing officer finds against you (probable cause to beleive you were impaired and you were in control of a motor vehicle) you were penalized without a license for 30 days if you took a breatherlizer test and the results were .08 or above. Today one can obtain a license for a hardship immediately on a regular license and forgo the hearing without any moments of not driving. This again does not apply to people who drive commercially and should request a formal review hearing within 10 days of your arrest.
