Gender identification discrimination is not currently part of Title VII.

Senator Tom Harkin (D-Iowa) re-introduced the bill adding gender identification to Title VII.  He said: ““Lesbian, gay, bisexual and transgender Americans are first-class citizens; they are full and welcome members of our American family; and they deserve the same civil rights protections as all other Americans—to be judged based on their talent, ability, qualifications and what they can contribute, not by their sexual orientation or gender identity.”

Multiple states now protect gender identity from discrimination, harassment and other unfair treatment.  Missouri’s senate recently passed a bill protecting gender identity – however the Missouri House did not have time to take the bill up, so the bill failed because the legislative session came to an end.

Unlike gender identification, “gender” itself is protected.  For instance, a man or woman cannot be mistreated because of their gender (male or female).
