Hamblett & Kerrigan represented an injury victim who was injured in a rear end automobile accident.  While stopped legally with the left directional signal engaged, the injury victim was struck from behind due to the negligence of another motorist who was distracted and not paying attention.  As a result of the accident, the injury victim sustained significant personal injuries.  In an effort to resolve the rear-end accident prior to filing suit, we prepared an extensive demand letter with evidence of the injury victim’s damages to the negligent driver’s insurance company and demand that they pay the injury victim the full amount of the insurance policy.  Despite liability clearly resting with their insured, the negligent driver’s insurance company never responded to the demand for the policy limits. 

Given that the insurance company failed to respond to our demand to compensate the injury victim fairly for the injuries sustained as a result of their insured’s negligence, Hamblett and Kerrigan filed suit on behalf of their client.  Within only a few weeks of filing suit, Hamblett & Kerrigan was able to get the insurance company to offer the negligent driver's entire automobile policy limits. While it is Hamblett and Kerrigan’s goal to settle a case prior to suit, it is also important for the injury victim's attorney to be willing to file suit when settlement negotiations do not result in fair compensation for his/her injuries. 

 In addition to obtaining the negligent driver’s entire policy limits, Hamblett & Kerrigan negotiated with the injury victim's health insurance company and sought a reduction of the amount the injury victim was to reimburse the health insurance from the settlement proceeds.  Hamblett & Kerrigan was able to successfully negotiate a one-third reduction of the health insurance company's claim for reimbursement, resulting in a savings to the injury victim of over $6,000.00.
