Jack Bergeron and Adam Bergeron, personal injury attorneys at Bergeron Paradis & Fitzpatrick (BPF), settled multiple claims for a Vermont man who suffered personal injuries after his vehicle was hit head-on by a driver fleeing from police. BPF first obtained a settlement with the insurance company for the vehicle fleeing from police, and then settled with the plaintiff’s insurance company for underinsured motorist benefits. Finally, BPF sued the police department alleging that its officer was negligent in conducting the high speed pursuit which resulted in the head-on collision. The defendant filed a motion for summary judgment claiming that the police officer was immune from the lawsuit under the doctrine of qualified immunity. BPF filed a memorandum of law opposing the motion and prevailed in a decision from the Vermont Superior Court. The court held that the police officer was not immune from the lawsuit and that the case could proceed to trial. Shortly after the court’s decision, the case was settled at mediation. The total compensation to the plaintiff was in excess of $1,000,000.00.
