How Do I File a State Administrative Complaint?

The complaint must allege a violation that occurred within one year prior to its submission, and it must be submitted in written form and signed. The following must be included in the complaint:

• The school district, department of education, or other public agency or the state statutes and regulations that did not uphold federal (IDEA) or state special education laws

• The facts and information that the complaint is based on

• The signature and information for the individual or organization who filed the complaint

If the complaint involved a certain child, it must include:

• The child’s name and address

• The name of the child’s school

• School and contact information for the child if they are homeless

• A description of the child’s problem (including related facts)

• A suggested solution to the problem based on the available information at the time the complaint is filed

The individual or organization submitting the complaint must send a copy of it to the school district against which the complaint is filed right when they submit it to the CSDE.
