To request a due process hearing, you or the school district (or your attorney or the school district’s attorney) must submit a due process hearing request to the other party. Submitting a due process hearing request is equivalent to requesting a hearing. This request must include all necessary information and must remain confidential. The due process hearing request must include:

  1. The child’s name

  2. The child’s address

  3. Contact information for the child if they are homeless.

  4. A detailed description of the issue concerning the proposed or denied action, including relevant facts

  5. Proposed solutions to address the issue, based on what is currently known and accessible to the party filing the complaint

  6. The name of the child’s school

A due process hearing will not take place until one of the parties files a due process hearing request (the parent/parent’s attorney or the school district/school district’s attorney). The request must contain the above information, and whoever files the request must send a copy of it to the Connecticut State Department of Education.
