HOW TO DRAW UP A PRE-MARRIAGE CONTRACT.

First, hire a divorce lawyer. You'll want an experienced divorce lawyer, because a prenuptial agreement is basically a pre-divorce agreement.

Network among colleagues and friends and consult with several of the recommended attorneys,

both for advice and as a preemptive strike against their spouses' hiring them later.

Include your work compensation and all your financial assets and liabilities. Don't fill your contract up with a lot of emotional stuff that can turn out to be questionable if challenged in Court.

Cecile C. Weich, an attorney who works in the area of Divorce and Family Law, suggests inflating your net worth 10% to 20%. That way your spouse can't argue later that anything was undervalued.

Full disclosure is the key to a solid pre-marriage contract, Ms. Weich tells her clients, to include details of travel and entertainment budgets and other perks that you receive from your employment.

When you get your contract signed, have the signing videotaped. Often spouses later challenge prenups, charging the agreements were signed under duress. If duress can be proved, the Court can throw out a contract. A videotape is powerful ammunition that shows a person's real mood, less intrusive, but just as effective, is a stenographer to record what is said by both parties during the signing of the agreement.
