Husband Gives Child Check For Child Support

A court found a husband in contempt of court and ordered that he pay $1,000 toward the wife's attorney fees, because he allegedly bypassed the wife and paid child support directly to the parties' child. The parties married in October 1992 and have four children. They separated in May 2013 and agreed that the defendant husband would pay child support. In September 2015, the court converted the separation into a dissolution of marriage. Plaintiff wife filed a motion for contempt and alleged, inter alia, that defendant paid child support directly to the parties' child and failed to pay alimony and child support to her. The court found that in December 2015, defendant gave a check in the amount of $6,000 to the parties' child and did not pay alimony and child support to plaintiff wife. "By initially paying the child support to the child," as opposed to the wife, wrote the court, "defendant violated the current court order." The court did not credit defendant husband's explanation, and it held the husband in contempt of court and ordered that he pay $1,000 toward the wife's attorney fees. The court ordered defendant to pay alimony and child support by automatic direct deposit in the future and to provide written proof that the wife was named as beneficiary of his life insurance and retirement accounts. The court ordered the parties to divide retirement account and did not find and evidence that defendant, and investment advisor, made any inappropriate investment decisions.
