The plaintiff small van driver, in his late 20's, contended that he was stopped at a red light and when it turned green he resumed driving when the defendant driver of a 20 foot box truck failed to stop at his red light, striking the passenger side of the plaintiff's car. The defendant and the defendant's passenger contended that the defendant's light was green as they approached the intersection and remained green as they entered. The plaintiff was alone in his car and would not have produced independent eyewitness testimony.
The plaintiff maintained that he suffered a closed head injury and traumatic brain injury (TBI) that will permanently manifest in cognitive deficits involving memory and concentration. The plaintiff maintained that the results of neuropsychological testing supported his contentions. The plaintiff, who was an HVAC apprentice at the time of the collision, contended that he could not continue and that the plaintiff, who is now working for an automobile dealership, is earning significantly less than he would have earned. He made future income claims of approximately $800,000.
The defendant denied that the plaintiff suffered the claimed deficits and denied that the neuro-psychological testing reflected sincere difficulties. The defendant also maintained that the plaintiff's income claims were speculative in nature. The case settled for the plaintiff prior to trial for $745,000. [1]
