A jury’s decision to award $150,886 to a police officer, which included $133,000 because he retired early as a result of the injuries sustained in a motor-vehicle accident, failed to shock the court’sconsciencePolice Officer Gregory Iamartino alleged that on May 18, 2013 he was en route to Bridgeport Hospital when another motor vehicle collided with his motor vehicle, and he was injured. Allegedly, Iamartino suffered from headaches, neck and back pain as a result of the 2013 motor-vehicle accident. Previously, Iamartino had undergone a cervical fusion and suffered from Lyme disease. Although he had planned to work another four years, which would have resulted in 30 years of service as a police officer, Iamartino concluded he was unable to continue working as a result of the 2013 motor vehicle accident, and he retired. Defendant admitted legal responsibility and the parties disputed the amount of damages. A jury awarded plaintiff $7,053 for medical expenses, $10,833 for loss of earnings from working overtime and $133,000 for loss of income from retiring early. Defendant moved for a remittitur and argued that the jury engaged in conjecture when it awarded compensation for retiring four years earlier than previously planned. In 2012, plaintiff earned $95,000. “The issue,” wrote the court, “is the impact of the injuries sustained in the subject accident upon the plaintiff who had preexisting problems.” The jury could have credited plaintiff’s allegations that he continued to experience significant pain as a result of the May 2013 motor-vehicle accident and was unable to keep working. The jury reasonably could have found that plaintiff lost $133,000 in earnings, because he retired four years early. Motion denied.
