The plaintiff motorcycle operator, 36 years old, who was proceeding West on I-78, contended that the defendant automobile driver made a sudden lane change to the left across multiple lanes of traffic and struck the right side of the plaintiff's motorcycle.

As a result of the motorcycle collision, the plaintiff suffered a non-displaced fracture of the 4th metatarsal shaft and small avulsion fractures at the lateral cuboid. The plaintiff underwent skin grafting from right thigh to right ankle as well as multiple procedures for debridement of the right ankle. His plastic surgeon testified that the residual noticeable scarring is permanent. The plaintiff also maintained that he will permanently be deprived of the same strength as his left leg, which limits strenuous activity. He further contended that because of the severity of the injury to the nerves in his leg and foot, he continues to suffer lateral ankle and foot numbness and maintained that in view of the continuation of the symptoms for almost three years, the condition is permanent in nature.

The plaintiff missed approximately five months from his job as an electrical mechanic. He is married and has three children. The case settled in favor of the plaintiff prior to trial for $625,000.
