Oklahoma Criminal Law- The 3 Basic pleas
In most Oklahoma criminal courts you can expect to either go to trial or to enter some type of plea negotiation. If you enter into a plea negotiation you likely will be given one of three options- a Deferred Sentence, a Suspended Sentence, or some type of PSI or Pre-Sentence Investigation.
A deferred sentence is one in which you plea guilty or no contest, however the judge does not sentence you or accept the plea formally. The judge instead defers your sentencing based upon the condition that you complete the rules and conditions of the plea, pay fines if any, any do not violate any new laws. At the conclusion of a deferred sentence, the defendant record is usually expunged.
A suspended sentence is a plea in which you are accessed jail time however that time is suspended in full or partially. A suspended plea or sentence WILL REMAIN ON YOUR RECORD.
A PSI or pre-sentence investigation is basically a blind plea in which the Judge is the actual person that gives punishment based upon and investigation done by the probation department. This investigation is through and includes history of past crimes, arrests, and current and past drug usage and employment history.
