The Court determined that since the Department of Environmental Protection does not regulate private water sources, the General Assembly’s distinction between private water
supplies and public is reasonable when giving notice of possible potentially hazardous conditions in the public water supply. Thus, the DEP does not have to locate, identify, and give notice to all private well owners in the case of a spill.
The court also restricted disclosure of the specific chemicals used in fracking as trade secrets when physicians are treating those affected.
