Pregnant Woman Awarded $75,000 For Pain and Suffering in Horse Collision

In the case Billings v. Benevides, passengers in a motor vehicle sued for injuries arising from their vehicles collision with a horse that entered the road in front of their vehicle. The court entered a default judgment in their favor, because the owners of the horse failed to appear in court. In this action, the passengers look to recover both economic and noneconomic damages. In law, economic damages are compensation for monetary expenses related to an injury, such as medical costs and even lost wages. These damages are easily verified by medical bills, invoices, and employment records. Noneconomic damages compensate individuals for non-monetary losses, which are not readily quantifiable. Examples include pain-and-suffering, loss of future enjoyment, and loss of companionship. These damages are subjective, and determined by the jury or finder of fact.
On July 17, 2010, the passengers were traveling on Route 66 in Columbia, Connectict. Allegedly, a horse owned, maintained and controlled by the owners John and Kimberly Benevides, entered Route 66 directly in the path of the vehicle and caused a collision. The passengers were injured in the collision. One passenger, Diane M. Billings, sustained a laceration on her eye, and was deeply concerned for the welfare of the other passenger, her pregnant daughter. The daughter, Stacey Brugnulo, was eight months pregnant at the time of the collision. The collision caused her to be concerned about the condition of her unborn child. She suffered breathing problems, anxiety and headaches after the collision.
After due hearing, the court established that the passengers were entitled to compensation for their injuries. Kimberly Benevides, the mother, was awarded a total of $8,477.27 for economic and noneconomic damages. The daughter, Stacey Brugnulo, was awarded a total of $81,884.27, $75,000 of which accounted for the fear, pain and suffering caused by the accident.
