Rear-Ended Couple Recovers $900K in Mediation

August 2013, the plaintiff husband was driving on I-95 in New Haven when he slowed his SUV due to heavy summer traffic. A tractor-trailer owned by M&G Trucking and driven by its employee, the defendant, both of Rhode Island, plowed into the back of the SUV, pushing it into the car ahead of it. The SUV was totaled; the plaintiff husband lost consciousness, and the plaintiff wife, a passenger, and suffered serious chest injuries. The vehicle was pushed into and came to rest at the divider where you can either stay on I-95 or bare left to get onto Interstate 91.

The defendant truck driver told police that his load had suddenly and unexpectedly shifted, he could not stop his truck in time and the accident was not his fault. The responding police officer disagreed and ticketed him for following too closely and driving with an unsecured load.

The plaintiff husband, 69, was diagnosed with a concussion, a fractured pelvis and a left shoulder injury. He had an arthroscopic procedure on his left shoulder. He was subsequently diagnosed with post-traumatic stress disorder and extreme anxiety especially when driving, for which he went through cognitive therapy. His medical bills totaled $74,000. His orthopedist assigned him 39% permanent disability impairment, including 14% to his neck, 15% to his shoulder, 7% to his lumbar spine, 9% to his left hip and 2% to his knee. A self-employed court reporter, he valued his lost earnings at $130,000.The plaintiff husband suffers from daily pain and cannot sit for long periods of time. He can no longer handle trials as a court reporter, only short hearings.

Meanwhile, the plaintiff wife, 62, was hospitalized for three days with six fractured ribs, a liver contusion and neck and torso sprains. She then underwent physical therapy and received steroid injections to her lumbar spine. She received a whole person permanency disability rating of 23%. Her medical bills have totaled $60,000. Doctors say she will need a lumbar decompression and fusion surgery sometime during her life. The estimated cost of that procedure is $60,000. Both plaintiffs needed counseling after the accident.

The lawsuit was filed in federal court and assigned to U.S. District Judge Covello in Hartford. Charles Corcoran mediated the dispute between the two parties. The case settled, with the plaintiff’s each being awarded $450,000.
