Plaintiff widow filed a wrongful death action against defendants, state, a driver, and a trooper, for the death of her husband as the result of an automobile accident.

The decedent was operating a tractor trailer truck on the highway when he was stopped for a speeding violation by the trooper. Within minutes after being stopped while proceeding to a grassy area of the highway, decedent was mortally wounded when his body was violently impacted by a hit and run automobile. After impact, decedent's body struck the trooper, knocking her under the cruiser. As a result of being struck by this hit and run automobile, decedent suffered a traumatic amputation of his lower left leg and massive internal injuries, which resulted in his death. The widow filed a wrongful death action against the driver of the hit and run automobile, the state, and the trooper. The only eyewitnesses to the accident were the driver and the trooper. The driver testified that while she was driving she started to fall asleep. Her head went down, she heard a thud, the car shook, and she hit something. The thud woke her up. She looked up and saw the people in the road. She saw a car, a truck, and two people. The court found no negligence on the part of the state or the trooper. The court stated that the sole proximate cause of the decedent's death was the driver's conduct.The court found no negligence on the part of the state or the trooper.
