A wage garnishment (or wage attachment) is a process that creditors use in order to collect debts that are owed. It is an order from a court that is delivered to a person’s employer. It requires the employer to withhold a certain amount of money from a person’s wages. In Alabama, creditors are allowed to withhold up to 25% of a person’s paycheck until the total amount of the judgment is satisfied.  Until the judgment is completely satisfied, interest continues to accrue on the unpaid balance.

By filing Chapter 7 or Chapter 13 bankruptcy, most garnishments are stopped automatically. If your wages are currently being garnished or if a creditor is in the process of garnishing your wages, call the law firm of Bouloukos, Oglesby and Mitchell and find out how to stop the garnishment process.
