Traveling to the United States

I often get clients asking me questions pertaining to traveling and having a Criminal Record. Here is a brief answer to that question.
Question: What is a Pardon and can it help me travel to the United States
Answer: A Records Suspension, or formerly a Pardon prevents individuals and agencies in Canada from getting information about a conviction that one had in Canada. A Records Suspension is available to individuals who have been convicted of a criminal offence in Canada and then completed their sentence. The time one has to wait to obtain a Records Suspension depends on the offence, whether it was a summary or indictable offence. There is no guarantee one will receive a Records Suspension if they apply for it.
A Records Suspension does not assist a Canadian with a Criminal Record to obtain entry into the USA. If a Canadian has a Criminal Record and they have been deemed ineligible to enter the United States, then that person would have to apply for a Waiver to enter the United States. In essence having a Records Suspension does not allow entry into the United States if one has been deemed ineligible by the United States , you would require a U.S. Waiver.
