Under What Circumstances is a Child Placed in an IAES?

There are several cases in which a child will be placed in an Interim Alternative Educational Setting (IAES):

When a change of placement exceeds 10 consecutive school days, or if the child has been removed from their current placement for 10 school days in a given school year.

When a change in placement is proposed that would result in more than 10 consecutive school days and if it is determined that the behavior leading to the violation of the school’s code of conduct was not influenced by the child’s disability.

If the child: (1) carries or possesses a weapon at school, on school grounds, or at a school function; (2) knowingly possesses or uses illegal drugs or sells or attempts to sell a controlled substance while at school, on school grounds, or at a school function; or (3) has caused serious bodily injury to another person while at school or on school premises, they may be removed from their current placement and assigned to an IAES for up to 45 school days regardless of whether the behavior is considered a manifestation of the child's disability.
