Action to recover damages for, inter alia, the alleged negligence of the defendants, and for other relief, brought to the Superior Court in the judicial district of New Haven, where the complaint was withdrawn as to the defendant William Cardillo and where Adele P. Edgerton was substituted as the plaintiff; thereafter, the case was transferred to the judicial district of Waterbury, Complex Litigation Docket, and the complaint was withdrawn as to the defendant Matthew Vincent; subsequently, the case was tried to the jury before Dubay, J.; verdict for the substitute plaintiff; thereafter, the court, Dubay, J., denied the named defendant's motions for remittitur, a directed verdict, for judgment notwithstanding the verdict, to set aside the verdict, or for a new trial, and rendered judgment for the substitute plaintiff in accordance with the verdict, from which the named defendant appealed.

Where plaintiff's decedent had been injured when the car in which he was riding, which was being pursued by a volunteer firefighter, hit a tree, defendant town was entitled to governmental immunity under Conn. Gen. Stat. ยง 52-557n(a)(2)(B), because it would not have been apparent to its employee, a 911 dispatcher, that her acts or omissions would have been likely to subject the decedent to imminent harm, since there was nothing in the volunteer's 911 call to alert the dispatcher that he was speeding, driving aggressively, or improperly using his blue courtesy lights.
