What Are My Rights at a Due Process Hearing?
Any party involved in a due process hearing has the right to:

represent themselves;
-
bring an attorney or other individual who has knowledge about the student’s disabilities;

be represented by an attorney;
-
bring forth evidence, ask questions, cross-examine, and require witness attendance;
-
object to any evidence being presented that has not been provided to the party at least five business days prior to the hearing;
-
obtain a record of the hearing (written or electronic); and
-
obtain a written or electronic copy of the findings and decisions.
Parents at a due process hearing have the right to:

bring their child to the hearing;
-
open the hearing up to the public;
-
obtain a free record of the hearing; and
-
represent themselves at the hearing.
