What Are My Rights to Access My Child’s Educational Records?
Under the Individuals with Disabilities Education Act (IDEA), you have the right to access and review all education records related to your child. This includes records concerning the identification of your child as eligible for special education, evaluations to determine eligibility, your child's educational placement, and their right to a Free Appropriate Public Education (FAPE). To exercise this right, you must submit a written request to the school district, which must grant permission for you to inspect and review these records. The school district must grant you access to these records within 10 school days of making the request, or within 45 calendar days if school is not in session. The right to review your child’s records includes requesting explanations and interpretations of these records and getting a response, receiving one free copy of these records, and having somebody act on your behalf to review these records.
