What Are the Procedural Safeguards Available Under the IDEA?
Under the Individuals with Disabilities Education Act (IDEA), schools must notify parents of the procedural safeguards available to them, and provide an explanation of these safeguards along with IDEA regulations. Parents receive this notice once a year when:

A parent or school district asks for an evaluation for the first time;

A parent asks for a copy of the procedural safeguards;

A parent requests a due process hearing or files a state complaint for the first time in a school year; or
-
Disciplinary action is taken against a student which changes their placement.
